Brand Guidelines For Resellers/Launch Cart Sellers

For Product Creation, Social Media & Advertising

Copy Questions:

  • Can we say Cinderella, Snow White etc How can we say and use these names?

    • Yes, you can use these names and say them. If they are a part of something else, then they need a trademark. For example, Once Upon A Zombie characters are trademarked like ZOMBIE SNOW WHITE®

    • The names you can’t use are Disney created names for characters. For example:Disney created Aurora for Sleeping Beauty. The names are dependent on the story. If you have any questions, a quick google search will let you know what is original or Disney created. 

 

  • Can we say re-imagined? In ads?  Social Media? Product descriptions?

    • Re-imagined, only used on the non-vintage products.

 

  • Can we say Princess and, if yes, are there any restrictions?

    • If a character is classified as a Princess in her original fairy tale, then yes you can say it.

 

  • Can we use movie or book titles/references, such as Frozen or Jungle Book, etc.

    • If it is a Disney created title, then no, such as Frozen or Brave. The Jungle Book is safe to use because it is not trademarked by Disney, it is a book in the public domain. 

 

  • Do we have to incorporate “Toon Studio” branding into every design/copy description?

    • There needs to be a trademark in every product description.

      • Authorized Licensee/Reseller of the Toon Studio.

  • What are the biggest “Disney” triggers to be aware of and avoid?

    • DO NOT SAY DISNEY ANYWHERE.

Design Questions:

  • Since you have the rights to the original books, does that mean you also have the rights to use quotes from the books?

    • Yes. as long as it's our Junior Elf books.

 

  • Can we use character catchphrases, such as “Always let your conscience be your guide,” or “think, think, think” or phrases from the movies vs original books

    • You cannot quote movies.

 

  • Are there any restrictions to outside elements that can be incorporated into the artwork - backgrounds, etc?

    • No. as long as you are not using copyrighted material belonging to another owner of the copyright.

 

  • Can we alter the artwork, such as changing the color of outfits, remove elements (background, or flowers, etc), tweak facial expressions (smile bigger or close eyes, etc), etc? (If we have the expertise).

    • You cannot change colors without our approval. You can tweak facial expressions, yes. But again, we must approve.

 

  • Can we add characters to the artwork, such as dogs, friends, etc?

    • Yes.

 

  • Can we incorporate holidays or special events into the artwork (Mother’s Day, Pride, Christmas, etc). If yes, are there any restrictions? 

    • No restrictions. You can add Christmas caps to the characters, garland, Halloween masks etc.

 

  • Are there specific fonts to use for each character group? Or can we choose which fonts to use ie. zombie princess = use Halloween or ghoulish fonts if needed

    • You must use our fonts for Zombie Princess wording and for Once Upon a Zombie. We provided fonts as well for the trademarked names of the Zombie Characters. 

Product Questions:

  • Are there any products you do NOT want associated with your toons (crop tops, swimwear, face masks, etc)

    • No. As long as products are not pornographic or degrading to race or religion.

 

  • Are there any target markets you do NOT want associated with your toons, specifically potentially controversial causes such as political affiliations, Black Lives Matter vs All Lives Matter, climate change, etc

Usually don't call them cartoon characters as they never were cartoons, rather motion picture characters. Actually they are NOT motion picture characters. Our characters can be referred to as Iconic Fairy Tale Characters. Or Classic of Famous Fairy Tale Characters.

Here is a quick idea of how to brand the tee-shirts based on Original Vintage Art.

We found that if a licensee tried to pretend it's Disney, it DOES NOT work. We prohibit it.

We found that consumers LOVE this alternative Disney. They remember the art when they were kids.

Or, if they are young, they LOVE seeing this authentic retro art from the 1940s and 1950s and 1960s.

So every offer on a seller’s page should include original source art and a brief bio of the history of these beloved and cherished vintage brands from the world of Vinyl Records and Children’s Books.

Now, the creative possibilities are endless.
